Terms of Use

Please read these Terms of Use carefully before using sparkposter.com. By accessing or using SparkPoster, you agree to be bound by these terms. If you do not agree, please do not use the service.

1. Description of Service

SparkPoster is an online tool that lets you create quote images, affirmation posts, Pinterest pins, and other text-based social graphics. The service includes free and paid tiers with different usage quotas and features.

2. Account Registration

To access certain features, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately at support@sparkposter.com if you suspect unauthorized access to your account.

You must be at least 13 years old to create an account. By registering, you confirm that you meet this requirement.

3. Subscriptions and Billing

SparkPoster offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) through our payment processor, Creem. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.

Refunds. Subscription fees are generally non-refundable. If you believe you were charged in error, contact us within 14 days and we will review your request.

Usage quotas. Each plan includes a monthly generation quota. Unused quota does not roll over to the next month. We reserve the right to adjust plan features and pricing with reasonable notice.

4. Your Content

Text you provide. You retain full ownership of any text, quotes, or affirmations you enter into SparkPoster. We do not claim any ownership or rights over your input content.

Generated images. Images you create using SparkPoster are yours to use for personal or commercial purposes. You may share, publish, or sell content created with SparkPoster without restriction, provided it does not violate these Terms or applicable law.

Uploaded images. By uploading a background image, you confirm that you have the right to use it and that it does not infringe on any third-party intellectual property rights.

5. Acceptable Use

You agree not to use SparkPoster to:

• Create content that is illegal, hateful, defamatory, obscene, or harassing
• Infringe on any third party's copyright, trademark, or other intellectual property rights
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to the service, other accounts, or related systems
• Use automated means to access or scrape the service without prior written consent
• Resell, sublicense, or redistribute SparkPoster's platform or API to third parties

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Intellectual Property

SparkPoster, its logo, templates, and underlying technology are owned by SparkPoster and protected by applicable intellectual property laws. You may not copy, modify, or reverse-engineer any part of the platform without our written permission. Nothing in these Terms grants you a license to our intellectual property other than the limited right to use the service as described herein.

7. Disclaimer of Warranties

SparkPoster is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that any defects will be corrected.

8. Limitation of Liability

To the fullest extent permitted by law, SparkPoster will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use SparkPoster — including loss of data, revenue, or profits — even if we have been advised of the possibility of such damages. Our total liability for any claim related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, by sending an email to your registered address. Continued use of SparkPoster after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of SparkPoster shall be resolved through good-faith negotiation before any formal proceedings.
